Sadly this is true, well, whoever prepared this contract for Chelsea before handed them to Atletico was smart, a very smart move.

Hey we learned from mistake , when he played us in UEFA Super CUP . Although , we did allow him to play and did not challenge him much .
Maybe it is little unfair towards Courtois but his job is to gain experience for future of our club not to help some other club to beat us .

Was not Sahin's case similar that he only played first leg vs Real ? Atletico will probably pay for one leg or maybe two .

So here are Atlético's options:
They can draw Chelsea for the semi-final and not have Courtois, win, and have Courtois play in the final against Real or Bayern.
They can draw Real or Bayern for the semi-final and risk having to play the final without Courtois if Chelsea happens to qualify for the final.
They can pay Chelsea that lump sum, which probably won't happen.
Take your pick. 1-4.

So do Chelsea still want Courtois or are they just going to keep loaning him out? Surely Atleti should just agree to sign him Permanently and agree to pay a parentage of the lump sum so he can play. I would love to see Court play against Chelsea.

^Don't ask us Chelsea fans. We'll just give you mixed opinions on whether he should be sold or given the first team spot at Chelsea (I choose the latter). Just be patient and see how this ends.

It is so difficult to decide when you are team that has two inform , one of the best , goalkeepers in the world . I would sell him but put a buy out clause or if it is possible loan him . He needs to understand that his time will come and it is not like he is missing out on anything by being in Atletico . It is a fantastic club that plays for titles .

Atletico without Courthois can still be deadly, i want them to draw Chelsea no matter if Courtois doesnt play as long as Costa play...
Drawing Chelsea without Courtois in Semi is still the best option for Atletico.

this is what UEFA said regarding the matter:
"In response to media reports referring to the situation of Club Atlético de Madrid goalkeeper Thibaut Courtois, UEFA would like to reiterate its position."
"Both the UEFA Champions League and the UEFA Disciplinary Regulations contain clear provisions which strictly forbid any club to exert, or attempt to exert, any influence whatsoever over the players that another club may (or may not) field in a match."
"It follows that any provision in a private contract between clubs which might function in such a way as to influence who a club fields in a match is null, void and unenforceable so far as UEFA is concerned. Furthermore, any attempt to enforce such a provision would be a clear violation of both the UEFA Champions League and the UEFA Disciplinary Regulations and would therefore be sanctioned accordingly."

BUT, previously there was a similar situation, In July 2013, Celtic faced IF Elfsborg in the qualifying rounds. Celtic player Mo Bangura was on loan with Elfsbrg from Celtic and this was what UEFA said:
"As we, in line with the FIFA regulations on status and transfer of players, consider a loan to be a transfer, we do not have any regulations regarding players not playing against their parent club whilst on loan to another club. If a player is duly registered on the player list of IF Elfsborg then he can play against any team that Elfsborg are drawn against."
"Any agreement between the two clubs that this player wouldn’t play against Celtic should Elfsborg be drawn against them is purely between the clubs. **UEFA would not have any involvement or consideration of this agreement, it would be neither endorsed or enforceable by UEFA."**

I hope he does play, Atleti need him. If he doesn't Chelsea will face punishment from UEFA. Dirty tricks to try and get one over.
